The Letter
This is the full text of the letter. Once enough units have signed, it will be sent to the Board by certified mail, return receipt requested, with a copy to the Corporation’s registered agent. The signature page lists each signing unit.
Why certified mail? Under s. 719.106(1)(a)3., Florida Statutes, when a shareholder sends a written inquiry to the Board by certified mail, the Board must respond in writing within 30 days. Its answer must be substantive, or say that it has asked for a legal opinion or advice from the Division. Email does not start that clock.

Dear Members of the Board,
We, the undersigned shareholders, submit this written inquiry about the maintenance and management of the cooperative property. Under Section 719.106(1)(a)3., Florida Statutes, we request a written, substantive response within 30 days of receipt.
In recent weeks, two roof leaks have caused interior ceiling damage to shareholder units, and in one unit part of the ceiling has collapsed. A gutter is detached and hanging from the roofline. The cooperative has no professional management company. The results of the March 28, 2026 board election have not been counted or announced. Together, these conditions leave the property without consistent oversight, and shareholder value is at risk.
Please respond in writing to the following:
- Board composition. The Corporation’s 2026 annual report identifies seven officers and directors but no Secretary. Please identify who holds the office of Secretary, as the bylaws require.
- Management. Will the Board engage a licensed community association management company? If so, by what date? If not, how does the Board intend to provide ongoing oversight of maintenance and operations?
- Roof and gutters. What repairs have been made or scheduled for the recent leaks and the detached gutter? Who is performing roof work, and are they licensed, insured and engaged by the Board? When was the roof last professionally inspected? What is the current balance of the roof replacement reserve required under Section 719.106(1)(j)?
- Election. When will the March 28, 2026 ballots be counted and the results announced?
- Budget. On what date will the Board hold the meeting to adopt the 2027 budget? Will that budget include funding for professional management and roof maintenance?
We ask the Board to treat these matters with the urgency they require. Please direct your written response to Ted Lango, 2065 NE 56th Street, Unit 206, Fort Lauderdale, FL 33308, or tedlango@gmail.com.
Respectfully, The undersigned shareholders (signature page attached)
